Legal & Ownership

Can foreigners own property in Bali?

Foreigners cannot directly own freehold land (Hak Milik) in Indonesia. However, by establishing a foreign-owned company (PT PMA), they can acquire the Right to Build (Hak Guna Bangunan or HGB) title, which allows for long-term use and development of the land. 

Setting up a PT PMA involves significant capital requirements and ongoing administrative responsibilities, including regular financial reporting and compliance with Indonesian corporate regulations.  Additionally, properties acquired through a PT PMA must be used for commercial purposes, aligning with the company’s stated business activities. 

At SAMA Villas, we have chosen to offer our properties under leasehold agreements (Hak Sewa). This approach provides a straightforward, legally secure, and cost-effective solution for our investors, allowing them to enjoy long-term rights to the property without the complexities associated with establishing and maintaining a PT PMA.

Is the legal structure of SAMA Villas secure?

Yes. SAMA Villas is developed under our registered PT PMA (foreign-owned company). All contracts are arranged through a certified notary, and we provide full transparency and access to all legal documents, including the lease agreement, land certificate, and building permit.

We guide you through the entire process from due diligence to signing so you can invest with confidence, clarity and the right legal foundation.

Why don’t you offer freehold?

While freehold via a PT PMA is technically possible, it comes with high setup costs, legal complexity, and annual compliance obligations. As a boutique project, we’ve chosen the simpler, transparent leasehold structure to keep ownership clean, safe, and cost-effective for our buyers.

Land

What type of land title do I get?

You receive a leasehold title (Hak Sewa) for 30 years, secured in a legal agreement with a local landowner. This includes the right to extend for another 25 years, giving you up to 55 years of security.

Can I resell the villa later on?

Yes. Leasehold properties in Bali are commonly resold. You can transfer the lease to a new buyer at any point during your contract period, often at a capital gain depending on the market.

What happens at the end of the leasehold?

Our villas come with a 30-year leasehold title, with the option to extend for another 25 years under pre-agreed terms — giving you up to 55 years of secure usage rights.

If the lease is not renewed at the end of the term, the land and any structures built on it revert to the landowner, as is standard under Indonesian leasehold law. However, the furniture and interior fittings (movable assets) remain yours and can be removed or sold separately.

In practice, lease extensions are common — especially for well-maintained, income-generating properties — and we can help facilitate this process if and when the time comes.

Can I resell the villa during the lease period?

Financing

Can I finance the villa with a mortgage?

Indonesian banks generally do not offer mortgages to foreign investors for leasehold property, so most buyers purchase using personal funds or business capital. However, there are creative ways to finance your investment.

For example, some investors use the equity in their primary residence in Europe or elsewhere to secure a low-interest loan from their bank. This allows them to reinvest into a high-yield asset like a Bali villa where projected returns of 16–20% often outweigh the interest rate on the loan, making the investment potentially cash flow positive from year one.

If needed, we can connect you with financing advisors or help you set up phased payments during the development process.

Do I need to pay everything upfront?

No. Payments are typically made in milestones, linked to the construction timeline — for example: reservation, land preparation, structure, finishing, and final handover.

Is a down payment required to reserve a villa?

Yes, a reservation deposit secures your villa and blocks it from being sold to others. This amount is deducted from the total purchase price and is defined in your agreement.

Income & Tax

What kind of returns can I expect?

Based on similar properties in the area, projected returns are 16–20% annually, with 85% occupancy rates during peak periods. Actual returns depend on your pricing strategy, occupancy, and usage (full rental vs. partial personal stay).

Is rental income taxed?

Yes. Indonesia applies a flat 10% tax on net rental income. As a Dutch investor, you benefit from a double taxation treaty, meaning you don’t pay tax twice on the same income.

Are there ongoing costs I should plan for?

Yes. Costs like maintenance, property management, utilities, internet, cleaning, and tourism-related fees. These are relatively low and are factored into the net return projections. A full breakdown is included in the investment brochure.

Villa Management

Who manages the villa when I’m not there?

We work with House of Reservations, a trusted local partner who handles everything from bookings and guest communication to check-ins, cleaning, maintenance and reporting.

Can I still use the villa myself?

Absolutely. You can block out dates for personal use at any time, and rent it out the rest of the year to generate income.

Can I choose another management company then the one you recommend or do it myself?

Yes. While we recommend House of Reservations, you are free to handle it as you please.

How do I reserve a villa?

Start by contacting us for the latest availability and brochure. Once you’ve chosen a unit, we’ll guide you through the reservation, signing process, and payment schedule.

How long is the construction timeline?

Delivery is planned for September 2026. You’ll receive regular updates and photos during development, and all key stages are tied to transparent payment milestones.

Can I invest from abroad?

Yes. The entire process, including due diligence, signing, and payments can be handled remotely. We’ve designed the experience to be smooth and worry-free for international buyers.
